Semiconductor supply and pricing dispute

Retained as the semiconductor manufacturing and technology expert in a multi-billion dollar JAMS arbitration between two Fortune 100 companies, supporting two law firms with analysis of ASIC cost modeling, yield forecasting, and long-term supply agreements. Prepared an expert report and provided testimony and litigation consulting throughout the proceedings.

TRW v. Panasonic (MI & PRC)

Component failure in automotive safety systems electronics

Performed extensive data analysis and physical testing. Directed a two-year engagement establishing and operating a high-capability electronics testing lab. Findings contributed to successful outcomes in both U.S. and PRC courts.

Confidential Ongoing Federal Litigation

Software Copyright & Trade Secret Misappropriation

Testifying expert in a complex software IP dispute involving competing advanced process control (APC) platforms used in manufacturing environments. Analyzed alleged source code copying, misappropriation of protected design elements, and replication of graphical user interface functionality. Scope included analysis of literal and non-literal code similarity, evaluation of software architecture and logic, and review of license and nondisclosure compliance. Prepared Expert and Rebuttal Reports (2024), provided deposition testimony, with trial pending in 2025.

Ruiz Fajardo v. Flow Intl. (Federal)

Industrial machinery integration and warranty dispute

Prepared two expert reports, supported trial counsel onsite, and testified in Federal Court in an international case where the plaintiff, a Colombian company, operated the factory site in Colombia at issue. Opinions addressed repairs, warranty obligations, and compliance with industry standards.

Workplace Simulation Software

Copyright infringement and architectural comparison

Engaged as an expert witness in Federal Court concerning the marketability and capabilities of simulation and project-management software. Prepared an expert report leveraging PMI-PMP expertise in project management practices. Conducted architectural comparisons and provided litigation consulting.

Ocean Semiconductor v. Huawei

Multi‑patent invalidity in semiconductor packaging and process flow

Expert witness patent case engagement for the defendant, an international electronics and semiconductor manufacturing client. Testifying expert, produced invalidity reports for seven disparate patents.

About Richard Fincher

Richard Fincher is a consulting and testifying expert in disputes involving semiconductors, software, embedded systems, and manufacturing systems. He supports litigation teams in U.S. federal and state courts, international arbitrations (JAMS), and PRC civil courts.

As a former VP of Engineering, CTO, and General Manager, Richard combines hands-on technical depth with executive leadership in global manufacturing, electronics, and software systems. He has directed engineering operations across the U.S., Europe, China, India, and Australia, launching multiple global platforms and operations.

Richard holds an MBA (SMU Cox), MS in Computer Science (SMU Lyle), and BS in Computer Science (University of Texas at Dallas). He has also completed doctoral-level coursework in Computer Science and holds PMP and Lean Six Sigma Master Black Belt certifications.
